The record
“Purpose of the Fee — The purpose of the fee is to fund the expansion of library building space and collection resources necessary to maintain the City's established level of service as new residential development adds population that uses library facilities and materials.”
“Use of the Fee — Fee revenues will be used to finance the construction and expansion of library buildings, interior buildout, and on-site/code-triggered improvements necessary to place space into service; land acquisition is eligible when required to deliver the building program. Revenues will also fund eligible collection acquisitions (physical items and e-resources), related collection software, and public electronic equipment.”
“While the Development Impact Fee program is adopted on a citywide basis, two fee programs have defined service areas that do not encompass the entire City. Water System Facilities and Wastewater (Sewer) System Facilities fees apply only to development within the City-owned service areas ... Additionally, the Public Meeting Facilities, Library Facilities and Collections, and Parks fees are assessed on residential development only, reflecting the empirical basis for those fee programs.”

“Applicability and Collections: The Library Facilities and Collections Impact Fee applies to residential development only and is assessed per square foot of residential floor area. Mixed-use projects are assessed by category; only the residential portion is subject to this fee. For additions, charge only the incremental new floor area. For demolitions or removals, provide a credit for the prior area so applicants are charged only for the net increase.”
“Threshold: ADUs under 750 square feet are exempt from DIFs (§ 65852.2(f)(3)(A)). ADUs that are 750 square feet or larger may be assessed.”
“Credits and Reimbursements: Where an applicant constructs and dedicates eligible library facilities, dedicates land, or funds collection acquisitions accepted by the City that add capacity the program would otherwise fund, the applicant may receive a credit or reimbursement. Credits are limited to the lesser of (a) the City-accepted eligible capacity cost or (b) the portion of the fee attributable to the same improvement. Credits require a written agreement, are applied consistently with City policy, and do not create a right to a cash refund. No credit is provided for O&M, non-capital items, private on-site amenities that do not become a City asset, or improvements beyond program scope.”
“Effective Date and Transition: The fee schedule becomes effective on the date established by City Council. Applications deemed complete prior to the effective date are processed under the prior schedule unless otherwise provided by ordinance or agreement. Existing development agreements and duly executed reimbursement/credit agreements are honored according to their terms.”
