“6.04.010 Purpose. The purpose of this title is to provide funding for water and sewer services and facilities which the district's board has found to be necessary and appropriate.”

“"Capacity charge" means contribution toward existing or future capital improvements, for facilities in existence at the time the charge is imposed or charges for new facilities to be constructed and operated in the future which are of benefit to the person or property being charged. Capacity charges shall apply to the expansion, extension, and increased utilization of any service connection where use of the service or demand on the district's system increases.”

“The water capacity charge for each equivalent dwelling unit ("EDU", as defined in Section 1.04.010) shall be as follows: • Marina Water service area $6,800.00 per EDU. • Ord Water service area $13,900.00 per EDU.”

“Capacity charge. The capacity charge shall be determined by the board from time to time and set forth by ordinance. It shall be based on the number and size of service connections and shall be payable upon application for service (or upon construction and prior to acceptance of or service to an in-tract water system in the case of developers).”

Marina Coast Water District, the agency that levies it

“Water and Sewer Capacity Charge - The District collects capacity charges from developers or customers to connect to existing water and sewer systems. Capacity charges help cover the costs associated with extending or enhancing infrastructure to accommodate new demand.”

“6.16.020 Charges to schools, colleges, and state agencies. Notwithstanding the foregoing, the capacity charge shall not apply to any of the following: A. Any school district; B. The county office of education; C. Any community college district; D. The California State University; E. The University of California; or F. Any state agency.”

“Credit for construction of facilities by developers or owners. 1. The cost of out-of-tract facilities (including engineering design fees) after certification as reasonable and proper by the district engineer may be credited against capacity charges. 2. If the approved cost of facilities exceeds the required charges, the district may enter into an agreement to refund such excess from capacity charges collected for a period not to exceed ten years from future connectors to such out-of-tract facility.”
