“School Facility Fees may be levied "for the purpose of funding the construction or reconstruction of school facilities". Fees may not be used for regular maintenance, routine repair, inspection or removal of asbestos containing materials, or purposes of deferred maintenance, as defined. / Level 2 School Facility Fees shall be used by this school district for the construction of school facilities at existing and future campuses.”

“Fees collected in the next five years will be spent on known and future school construction projects. Projects may include but are not limited to the following: 1. New school sites 2. New schools 3. New classrooms at existing schools 4. Support facilities (cafeteria, gym, library, restrooms, etc.) at existing campuses to accommodate increased enrollments 5. Portables used for interim housing needs 6. Replacement of portables with permanent classrooms”

“Compliance with the preceding nexus requirements establishes that the Elk Grove Unified School District is eligible to impose these fees authorized by State law. The following map shows the geographic area for which the District is authorized to collect these fees.”

Ms. Albiani then closed the public hearing. / Motion No. 136, 2025-26, Motion by Ms. Ballerini, seconded by Mr. Yang and carried unanimously by an affirmative vote of all board members present that the findings contained in Resolution No. 86, 2025-26, adopting the Increase in School Facilities Fees and Resolution No. 87, 2025-26, adopting the Alternative School Facilities Fees be approved.”

“School Facility Fees for this school district will be collected, absent other arrangements such as SB 937, prior to issuance of a building permit. ... SB 937 allows for specific types of residential projects to pay the school facility fees prior to occupancy instead of prior to the issuance of the building permit.”

“Please note that pursuant to Education Code Section 17620, our local building departments may not issue a building permit for any construction within the District's boundaries until the District has executed a Certificate of Compliance indicating that the developer has paid the required school fees.”

“Exempt from School Developer Fees: Accessory Dwelling Units (ADUs) 750 square feet or less; Residential additions 500 square feet or less; Non-habitable spaces (carports, garages, storage sheds, barns, patios/overhangs); Public Agencies (federal, state, county, city and local government; park districts, public schools)”

“Level 3 fees greater than the Level 2 amount may need to be reimbursed if an agreement is established and State funds subsequently become available. / In certain cases, builders and buyers of qualifying affordable housing, may be eligible for State reimbursement of the difference between Level 2 and Level 3 fees.”
